Adonis Village: Request for External Change –  Unit U6

 

Description of proposed external change:

A request is made by the owners of U6 for an external change to their property in line with the agreed Adonis Village procedure.

As has already been carried out in a number of other properties within the Village (ie. U5, U4 amongst others) the owner of U6 would like to convert the bedroom window to a French patio-door by extending the drop (the width remaining the same) of the bedroom window looking out over the patio. The shutters will also be replaced for a metal version as per official materials and colour. This will therefore provide access to a patio which is to be tiled and new matching hand rail fitted to enclose the whole balcony perimeter.

The owner and supplier will guarantee that the replacement patio-door and shutters will be exactly the same design (look and style) in terms of dimensions and features as those that already exist. Patio tiles will also be matched (due to age, these will be as close as possible). It will match the official colours of Adonis Village and will not look discerningly different from the existing ones from a reasonable distance of 10 metres, as is the case with the other properties that have changed their windows and doors. Also, please note that the new bedroom patio-door is not visible by any neighbour, with only a view out over the ravine.

The window will be of similar design with the exception of them being UPVC French doors. 

The installation will be carried out by one of the two approved suppliers and will be completed in 2024, following the end of the Request for Change process and to suit the owners and installation company. The owner commits to completing the work during low season, in order to disturb as little owners/guests as possible.

    I would like to address the information provided above, which indicates that certain work has been completed at U5, although I have not seen or been made aware of any external change request for the work exemplified in the accompanying photograph.

    I kindly request that the Management Committee confirm whether there are any violations related to this matter. It is crucial that we also verify if the necessary permissions were obtained and if the correct external change procedures were followed, particularly with regard to the extension of the balcony onto another unit's flat roof.

    In addition, I seek clarification regarding the approval process for the use of non-matching tiles that are not in line with our established standards. The quality of this work appears to be substandard and lacks the meticulous attention to detail that we expect within our community. Such deviations from our guidelines have the potential to negatively impact the overall aesthetic and cohesion of our complex.

    Furthermore, it's essential to clarify that the Adonis Village Management Committee does not possess the authority to grant an "approved legal status" to contractors or workmen. Every owner within our community is entitled to engage the services of any supplier or workmen for their property, provided that the required permissions are duly obtained from the appropriate legal body. I have been informed by another owner in Adonis that Mr Morley has been embroiled in legal disputes with fellow Adonis residents due to the delivery of substandard products and services.

    Preserving the principles of fairness, quality, and transparency within our community is of utmost importance, and we must remain vigilant to ensure that such issues are addressed and rectified promptly.

    I kindly request that the relevant parties involved in this matter investigate and address these concerns promptly.

    The Adonis Village Management Committee recently approved the U6 external change request and conveyed the decision as follows: "The AV Committee has evaluated the above planning request and has concluded that it should be APPROVED subject to any objection from owners in the next 28 days. The planning request has been posted on the Adonis Village Notice Board and emailed to all neighbouring owners."

    However, upon careful investigation, it has come to our attention that the statement claiming, "The planning request has been posted on the Adonis Village Notice Board," is a false statement as the committee has not posted this external change request in/on the Adonis Village Notice Board. According to the Legally Binding Adonis Village General Agreement, the Adonis Village Management Committee is obligated to post such requests on the Adonis Village Notice Board. The fact that this notice has not been posted in/on the Adonis Village Notice Board constitutes a serious breach of the Adonis Village General Agreement.

      As the website moderator and in the absence of a functioning management committee due to the failure to appoint one at the last AGM. I would like to provide a personal and informal answer to this question.

      The physical notice board at the entrance is not effective due to the fact there is a barrier wall preventing visitors to approach the board safely and that the board is without any shade or lighting.

      Therefore, for many years now, the Adonis Village website has been the official notice board, which provides greater accessibility and reaches far more owners. However, in my personal opinion, while the 28 days notice period is still valid from the approval date, I suggest that no development is commenced until a new Committee is appointed and has replied formally.

      Dear Committee!
      As the owner of U3, I am categorically against such changes in U6, because my roof structure will be damaged, which has caused waterproofing problems. The construction works will also damage the condition of the walls and ceilings of my property. This was already observed after U6's unauthorized bathroom repair, which was carried out during the season, disturbing the peace of the tenants. Cracks appeared in the ceiling of my property. If this technological change will be made, the relevant authorities will have to be contacted.

        First I would like to ask if who ever approved this visited the property and evaluated the application before approving it?
        This application is for a window replacing it with a door the picture shown is not the actual location, in this case the proposed door will be opening on the flat roof of the unit below.
        What the committee is approving is giving access to the owner to have a patio on the roof on the unit below this is unacceptable and should not be approved .

          Committee - can I please ask that the notice is added to the noticeboard as soon as possible as per procedure.

          A bit about us…. The property was purchased off plan over 20 years ago by my wife’s parents, who have both since passed and my wife inherited the property a number of years ago when her late father passed away. My wife and I have been visiting regularly ever since and very recently, our son. We are very proud owners of the property within such a beautiful village and are merely trying to bring the property up to its full potential as per neighbouring properties.

          Over the time of having the property, absolutely no internal changes have taken place and were well overdue. The property was in its original state from the purchase date. The bathroom had deteriorated to a level whereby we had a leak and cracked tiles - therefore, the work was required urgently for letting purposes. In terms of the extensive work that was done, it was the replacement of the bathroom and interior painting. After checking with Michael, he confirmed that no approval is required for internal works. We would have preferred to do it during a less disruptive period, not only for others but also ourselves. We do apologise to U3 for the work overrunning in peak season but I hope you understand that the work was a must.

          We are aware that U3 requested a loss of earnings at €150 per day, this was very concerning, so we did follow up with the rental company and understand that the tenants were offered an alternative property and they declined. Although there was no loss, we do see this as an inconvenience.

          The work that we hope to do in January, we are following suit of U5 and U4, amongst other one bedrooms in AV. All colours and requested materials will be those determined by the committee and GA. We hope that this gives some reassurance as to what we are hoping to achieve.

          Valdis, we respect that you are affected being directly below us. This is the first time hearing that you have cracks to your property due to our work that occurred recently. There is always a chance of cracks naturally appearing from any work being undertaken to an adjoining property. We fully appreciate your concerns and we would cover any potential remedial works and would like to reach out for your help in making this possible.

          It is a shame that we didn’t get to meet and discuss this at the AGM, but as I’m sure you will agree, the meeting didn’t quote go as we all would have wished.

          We are going to be in the village for the foreseeable future and we like to have good relationships with everybody, whilst building new relationships within the community.

          Can I ask you to reconsider your objection or be open to a conversation, so that we can reassure you of our objectives.

            Dear Owners!
            About rebuilding U6.
            Cyprus and AH buildings are built in compliance with soil, climatic and seismic requirements. Our MC used to be representatives of the project developer. They did not give permission to make changes to the project. Recently, it has been violated. Additional bedrooms are being built on the roofs. This has led to problems in the future.
            Now for the U block.
            It is built into the edge of the cliff and therefore requires extra attention in its maintenance and operation. Dismantling the walls and additionally loading the ceiling can lead to an emergency situation.
            When I bought the property, I already encountered several problems: microcracks, waterproofing, strengthening the foundations and restoring the external plaster. I have done all this on my own with no support from the community, although the roofs and walls are a community budget.
            I just want to emphasize once again to all owners of block U to protect their property and therefore I am against project changes, which will show problems to everyone in case of earthquakes and increased rainfall.

    Following an objection from another owner within the 28 days’ notice period, the AV Management Committee has re-evaluated the above external request, consulted with the owner and the objecting neighbour, and concluded that this ECR is now “UNDECIDED” on the basis that.

    1. Agreement from the owner of U3 has not been given.

    The AVMC will reconsider this decision if an agreement between the neighbours is achieved and recorded here. It is desired that the owners of both U3 and U6 will be able to find a common agreement on how to proceed. However, under no circumstances should any work commence without agreement of the parties and any such agreement to be posted under this ECR.

    It is noted that this external change is in keeping with the look and feel of the village, is a design feature already incorporated in the original Cybarco development of some of the other blocks and is an external change that many others have been given approval. In all cases the work has been structurally sound.

    It is further noted that all AV external walls, pitched and flat roofs are shared property of all block owners, and as such can be utilised by any neighbour if agreed by the other owners in the block, and meet the criteria for an external change though the ECR process.
